Breach Notification Revised Reporting and Timing Rules set forth by HHS are not going into effect. The current rules found at 45 CFR § 164.408 will remain in effect until HHS conducts another review of them and publishes any changes to them via a Notice of Proposed Rulemaking (NPRM). The only major proposed changes to the existing rule would: Nah, you guessed it, create new breach notification obligations for BAs.
